Terms of Service

1. Definitions

• Service: the software-as-a-service platform available at babywishgift.com and its subdomains (marketed as BabyWishGift).
• Provider: AEF WebDesign (Aef Webdesign SpA), a company incorporated in Chile that owns and operates the Service.
• Host: an adult (18 or older) who registers to create and manage a gift list or event.
• Guest: a person who opens a public list to view and reserve gifts or take part in an event, without registering.
• List: a gift list or event page created by a Host, identified by a unique link.
• Reservation: the action by which a Guest holds a gift for 24 hours.
• Activation Fee: the one-time charge that activates a List, with no subscription.

2. Acceptance of these Terms

These Terms form a binding agreement between you and the Provider. If you do not agree to them, do not use the Service. You must be at least 18 years old to create an account and to pay for a List.

3. The Service

The Service lets parents-to-be create gift lists for baby showers and related events and share them with guests. Features include:

• • Creating and customizing gift lists with visual themes.
• • Adding gifts from store links or by manual entry.
• • An anti-duplicate reservation system that expires automatically after 24 hours.
• • Purchase confirmation by the Guest.
• • Real-time updates.
• • A QR code and a downloadable invitation image.
• • Surprise mode: the Host cannot see who reserved a gift until after the event date.
• • Gender reveal events: Guests cast an anonymous vote, and the Hosts receive a summary of the results.

The Service only helps coordinate gifts. The Provider is not a seller of the gifts and is not a party to any purchase between a Guest and a third-party store.

4. Accounts

Hosts access their dashboard with a Google account or an email login. By registering you confirm that:

• • You are at least 18 years old.
• • The information you give us is accurate and kept up to date.
• • You are responsible for keeping your credentials secure.
• • You will tell us promptly about any unauthorized use of your account.

Guests do not need an account. Each List belongs to a single Host account.

5. Payments

Activating a List requires a one-time payment. Current prices, in USD, are:

• • Baby shower list activation: $9.99.
• • Gender reveal event: $9.99.
• • Pack (baby shower list plus gender reveal): $15.99.
• • Upgrade to the Pack for Hosts who already paid for one of the two: $6.00.

• • There is no subscription and there are no recurring charges.
• • A payment activates the List until after the event date.
• • Payments are processed by PayPal and are subject to PayPal's own terms. PayPal is the only payment method currently offered.
• • Card and payment credentials are handled exclusively by PayPal; we do not store them.
• • Prices shown at checkout are the prices you pay; any applicable taxes are shown there if they are charged.

We may change prices for future purchases with at least 15 days' notice. Payments already made are not affected.

6. Refunds and cancellation

To request a refund, email [email protected] within that period, with your name, the email address of your account and a statement that you want to cancel and be refunded.

We will refund you within 14 calendar days of receiving your request, using the same payment method as the original transaction unless you agree otherwise.

Nothing in this section limits any refund or other rights you may have under mandatory consumer protection laws that apply to you.

7. Guest reservations

• • A Guest can hold a gift for a maximum of 24 hours, without registering.
• • If the purchase is not confirmed in that time, the Reservation expires and the gift becomes available again.
• • Each gift can be reserved by only one person at a time.
• • A Guest confirms a purchase by entering the email address used when holding the gift.
• • We do not guarantee that purchases are completed with the external stores linked from a List, and we are not responsible for those stores' products, prices, stock or delivery.

8. Gender reveal events

In a gender reveal event, Guests may vote anonymously. Votes are not tied to a Guest identity shown to other Guests, and the Hosts see an aggregated summary of the results. Hosts are responsible for how they share the event link and for the content they put in it.

9. Your content

You keep ownership of the content you add to a List (gift names, images, event information, messages). You grant the Provider a non-exclusive, worldwide, royalty-free license to host, store, display and transmit that content solely to operate and improve the Service for you. You confirm that you have the right to post it and that it does not infringe anyone else's rights. We may remove content that breaches these Terms.

10. Acceptable use

You agree to:

• • Use the Service only for lawful purposes.
• • Not create lists for fraudulent or misleading purposes.
• • Not access other people's accounts or lists without authorization.
• • Not reverse engineer, scrape at scale, or copy the software.
• • Not upload malware or attempt denial-of-service attacks.
• • Not use Guests' email addresses for anything other than the event the Guest took part in.
• • Not post unlawful, hateful, harassing or sexually explicit content.

11. Privacy

How we collect and use personal data is described in our Privacy Policy. The Service is not directed to children, and Hosts must not create profiles for or collect data from children themselves.

12. Intellectual property

The software, design, brand and other elements of the Service belong to AEF WebDesign (Aef Webdesign SpA) or its licensors. You may not reproduce, modify or distribute them without written permission. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for your personal, non-commercial use.

13. Availability

We take reasonable steps to keep the Service available, but it may be interrupted for maintenance, force majeure or technical causes beyond our control.

14. Disclaimers and limitation of liability

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law:

• • We disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
• • We are not liable for indirect, incidental, special or consequential damages, or for loss of profits, data or goodwill.
• • We do not guarantee that links to external stores will stay available or accurate.
• • Our total liability for any claim relating to the Service is limited to the amount you paid for the affected List.
• • Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, or any non-waivable consumer rights you have where you live.

15. Suspension and termination

You can stop using the Service and ask us to delete your account at any time by emailing [email protected]. We may suspend or terminate access if you materially breach these Terms or misuse the Service, and we will give notice where reasonably possible. Sections that by their nature should survive termination (including content licenses, disclaimers, liability limits and governing law) will survive.

16. Changes to these Terms

We may update these Terms. We will notify you of material changes at least 15 days before they take effect, through a notice in the Service and/or by email. If you keep using the Service after the changes take effect, you accept the updated Terms.

17. Governing law and disputes

These Terms are governed by the laws of the Republic of Chile, where the Provider is incorporated, without regard to conflict-of-law rules. The courts of Chile have jurisdiction over any dispute arising from them, except that nothing here deprives consumers of mandatory rights or of the right to bring a claim in the courts of their place of residence where the law of that place requires it.
